1. General Provisions
1.1. The following terms and conditions of sale (“Terms and Conditions of Sale”) apply to the offer and sale of products through the website www.kocobelo.com
1.2. In order to purchase products on the Website, customers must: (a) be at least 18 years of age or, if they are minors, be duly authorized by their legal guardian; (b) be consumers, understood as natural persons acting for purposes outside their industry, trade, business and profession; (c) register on the Website; and (d) have a valid credit card.
1.3. This contract shall be formalized in Spanish.
2. Seller Identification
2.1. The seller is Banabana SA, a Panamanian company, domiciled in Panama City.
3. Products
3.1. Information about the products is available on the Website. Please contact us if you have any questions before purchasing.
3.2. The products described on the Website are for personal use only. Customers may not sell or resell such products. We reserve the right, with or without notice, to cancel or reduce the quantity of products or samples to be delivered to the customer where, in our sole discretion, this would constitute a breach of these Terms and Conditions.
4. Prices
4.1. All prices indicated for products that are available through the Website do not include tax at current rates and are denominated in US dollars. Shipping costs will be added to the price of the products and are indicated separately on the order form.
5. Placing Orders
5.1. To place an order, the customer must follow a series of simple instructions that appear on the Website.
5.2. To place an order, the customer must enter the quantity of the product they wish to purchase.
5.3. The customer must click on “Add” to place the selected product and the desired quantity in the shopping cart. The customer can check at any time during the purchasing process which products are included in the cart. The customer can save a product in favorites by clicking on “wish list”, after which the product will be placed in the customer’s favorites section in “My account”. To access a customer’s favorites from any computer, the customer must register or log in with his/her account.
5.4. The customer must follow the instructions on the screen to carry out the “purchase” process. The customer may always correct any errors in the data entered, change the contents of the shopping cart by adding or removing one or more products or cancel the entire order during the process before formalizing the order.
By placing an order, the customer acknowledges and declares that he/she has read all the instructions provided during the checkout process and fully accepts these Terms and Conditions. The customer places an order for products through the Website by clicking on the Send button at the end of the ordering process.
5.5. Once the order has been sent, a “Thank you for placing your order at Kocobelo” page will appear and shortly after, the customer will receive an email confirming receipt of the order.
The order confirmation email contains a summary of the Terms and Conditions, information on the essential characteristics of the purchased products, a detailed indication of the price and payment method, information on shipping costs, information on the conditions and methods for exercising the right of withdrawal, the address for submitting complaints and information on services.
5.6. If confirmation of an order does not arrive within 24 hours of placing it, the customer may contact us for assistance at compras@kocobelo.com 5.7. Should customers have any questions or concerns when placing an order or if they wish to make any enquiries, for a faster service, customers are encouraged to have their order number available.
6. Gift Wrapping Service
6.1. We always treat orders with special care. We will be happy to create a nice gift package. The Gift Wrapping Service entails payment by the customer of the additional cost indicated on the Website.
6.2. If the customer wishes to have their order gift wrapped, they will simply need to click on the “Gift Wrap” option during the checkout phase (“Order Checkout”). Customers are currently unable to include a card with a personal message.
6.3. In the event that a gift packaging request covers more than one product, we will create a single gift package for all of them.
7. Offer Codes
7.1. To redeem an offer code, the customer must enter their code in the “promo code” box during the checkout process on the website. Offer codes are case sensitive and must always be entered exactly as they appear.
7.2. When an offer code is accepted, the offer will be displayed in “Order Review”.
7.3. One offer code may be used per order.
8. Payment Options
8.1. The customer may pay for the products by credit card. The following credit cards are accepted for this purpose: – Visa – MasterCard
– Paypal
8.2. For customer security, the customer's name and billing address must match those on the credit card used to make the payment. We reserve the right to cancel any order that does not meet these criteria.
8.3. All credit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of the customer's payment card refuses, or for any reason does not authorise payment to us, either prior to or subsequent to a payment, we will not be liable for any delay or non-delivery.
9. Order Inquiries
9.1. Products are generally shipped several days after receipt of an order.

9.2. With a kocobelo.com account, customers can check the status of their most recent orders by visiting the Order Status page in the My Account section. This is the easiest and quickest way to get the most up-to-date information regarding orders.
9.3. When the customer clicks on the Order Status page, he/she will be asked to log in with his/her email address and password. The order summary page will provide the customer with detailed information about his/her current and previous orders. Once the order has been shipped, the relevant tracking number will be displayed, if available.
9.4. Occasionally, our system cancels orders or parts of an order for a variety of reasons. Some of these reasons include: Items not available Inability to process payment information Inability to deliver to the address provided Duplicate order placed Cancellation at the request of a customer
9.5. If an order is cancelled, the customer will receive an email explaining the reasons for the cancellation.
Customers will not be charged for cancelled orders. If the customer is interested in placing a new order or has any questions about a cancelled order, please write an email to the following address: customerservice@kocobelo.com
10. Delivery
10.1. Orders are processed and delivered exclusively on business days (Monday to Friday, excluding holidays). Orders placed on Saturday and Sunday will be processed on the following business day.
11. Right of Withdrawal
11.1. The customer may notify their intention to exercise the right of withdrawal by sending us an email to serviciocliente@kocobelo.com with the details including the customer's order number and the description of the products to be returned. If the products listed on the delivery note do not match those delivered, the customer must notify us immediately at serviciocliente@kocobelo.com
11.2. Our Customer Service department will then issue the customer with an authorisation number and an email confirmation. The customer is invited to retain his authorisation number for future enquiries with the Customer Service department in this regard.
11.3. In the event that the customer returns products for reasons other than them being defective or because their delivery was incomplete or incorrect, the customer must arrange and pay for their return.
11.4. In the event of exercising the right of withdrawal, we undertake to refund the price of the products to the customer within fourteen (14) calendar days from the date on which we receive your communication of withdrawal, provided that the products are returned by the customer and at his expense, unused and undamaged, having been maintained and handled with due care and attention, within 14 calendar days from the date of communication of your withdrawal. We reserve the right to withhold the refund to the customer until we have received the returned products. Refunds will only be made against the credit card originally used. Once the refund has been made, we will notify the customer by email.
11.5. It is strongly recommended that the package be sent using a recorded delivery service (which requires a signature upon delivery). We cannot be held responsible for returned products that are lost in transit.
11.6. The above provisions only apply to purchases made online. Products purchased in a store will be subject to the corresponding return policy of each store. Returns or exchanges of purchases made in a store selling Kocobelo products to the public cannot be returned or exchanged through Kocobelo Online; likewise, products purchased online cannot be returned or exchanged in such stores.
12. Lack of Conformity
12.1. In the event of non-conformity of the products, the customer has the right to have the products repaired or replaced, free of charge, so that they conform to the contract, failing which the customer has the right to an appropriate reduction in the price of the products or to cancel the contract. The customer waives the rights described above if he does not notify us of the lack of conformity within two months from the date on which he has detected it. In any case, actions initiated in relation to a lack of conformity that we have not maliciously concealed will automatically expire after 7 days from the delivery of the products.
